1. Introduction

These Terms of Service (“TOS”) govern the relationship between you (“Patient,” “Client,” “you”) and NJ Weight Loss and Preventive Care Clinics, P.A., under the direction of Dr. Daniel Olivero, MD (“we,” “our,” “us”). By enrolling in or using our weight-loss programs, services, or products (collectively, the “Services”), you agree to be bound by these TOS and all related agreements incorporated by reference.

2. Intake Forms and Required Agreements

Before receiving Services, all patients must complete and sign our Comprehensive Intake Forms, which include:

• A full medical history and disclosure of current medications, conditions, and relevant health information;

• HIPAA privacy acknowledgments;

• Informed consent(s) for each Service you elect to receive from NJ Weight Loss and Preventive Care Clinics, P.A. under the care of Dr. Daniel Olivero, MD;

• An Arbitration Agreement requiring disputes to be resolved through binding arbitration;

• An Authorization to Text and Communicate Electronically, allowing us to contact you for appointment reminders, treatment information, billing, and other necessary care communications;

• Any other agreements or consents deemed necessary for your particular treatment plan.

Completion of these forms and consents is required to initiate or continue Services.

3. Services

We provide physician-supervised weight-loss programs delivered by NJ Weight Loss and Preventive Care Clinics, P.A. and overseen by Dr. Daniel Olivero, MD. Services may include nutritional counseling, behavioral modification, pharmacotherapy, laboratory monitoring, and other interventions.

All clinical decisions are made at the sole discretion of Dr. Daniel Olivero, MD and his designated providers, consistent with applicable medical standards.

4. Privacy Policy and SMS/Text Communications

Your personal information, including medical information, is handled in accordance with our Privacy Policy, available on our website and incorporated herein by reference.

• By agreeing to these TOS, you acknowledge and consent to receive SMS/text messages from NJ Weight Loss and Preventive Care Clinics, P.A. and Dr. Daniel Olivero, MD for scheduling, reminders, care instructions, and administrative matters.

• You may opt out of non-essential communications by written notice; however, you agree that certain texts are necessary for the safe and effective delivery of Services, and opting out may affect your ability to participate in the program.

• All SMS/text communications are handled under HIPAA compliance to the extent required by law.

5. Payment and Fees

• You are responsible for all charges for Services, whether covered by insurance or not.

• Payment is required as outlined at enrollment. Fees may be adjusted at our sole discretion, with notice.

• Insurance reimbursement is your responsibility; NJ Weight Loss and Preventive Care Clinics, P.A. and Dr. Daniel Olivero, MD assume no liability for denied claims.

6. Cancellations and No-Shows

• Appointments canceled with less than 24 hours’ notice may incur a fee.

• We reserve the right to reschedule or cancel appointments at our discretion without liability.

7. Disclaimers and Limitations

• We do not guarantee weight-loss results or specific outcomes.

• To the fullest extent permitted by law, liability of NJ Weight Loss and Preventive Care Clinics, P.A. and Dr. Daniel Olivero, MD is limited to the amount you paid for Services giving rise to a claim.

• You agree not to hold us liable for delays, modifications, or interruptions to Services.

8. Termination of Services

We may, in our sole discretion, terminate Services with or without notice. Termination does not relieve you of financial obligations for Services already rendered.

9. Governing Law & Arbitration

These TOS are governed by the laws of New Jersey. Disputes will be resolved exclusively through binding arbitration, as set forth in your signed Arbitration Agreement with NJ Weight Loss and Preventive Care Clinics, P.A. and Dr. Daniel Olivero, MD.

10. Modifications

We may amend these TOS at any time by posting an updated version on our website or by notifying you directly. Continued use of Services constitutes acceptance of the revised terms.

11. Entire Agreement

These TOS, together with our Privacy Policy, Comprehensive Intake Forms, Informed Consents, Arbitration Agreement, and any additional agreements executed in connection with your treatment, constitute the full agreement between you and NJ Weight Loss and Preventive Care Clinics, P.A. and Dr. Daniel Olivero, MD.
